This month, Congress may consider extending Subchapter 5 in the Chapter 11 bankruptcy code. In 2019, Subchapter 5 was added with the goal of making reorganizing bankruptcies more accessible to small businesses. On February 25, Senators Dick Durbin (D-IL) and Chuck Grassley (R-IA) introduced legislation to extend the expiring debt ceiling on the program for an additional year to March 27, 2022. The new legislation seeks to provide additional relief for companies still facing economic challenges due to the ongoing COVID-19 pandemic.
